Welcome to MagnetPhotos! These Terms of Service ("Terms") govern your use of our website magnetphotos.ca (the "Site") and the services offered on it. By using our Site, you agree to these Terms.

1. Use of Our Service

MagnetPhotos provides a service to create custom photo magnets. You may upload your own photos to be printed on magnets. You are solely responsible for the content you upload.

2. User Content

You retain all ownership rights to the photos you upload. By uploading a photo, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your photo for the purpose of fulfilling your order.

You agree not to upload any content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

We reserve the right to reject any order that we deem to be in violation of these terms.

3. Orders and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information.

All payments are processed through our third-party payment processor, Stripe. We are not responsible for any errors or issues with the payment process.

4. Shipping and Delivery

We will ship your order to the address you provide. Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers or customs.

5. Returns and Refunds

Due to the custom nature of our products, we do not accept returns or offer refunds unless the product is defective or we made an error in printing. If you receive a defective product, please contact us within 14 days of receipt with a photo of the issue.

6. Limitation of Liability

To the fullest extent permitted by law, MagnetPhotos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes.
